(1) If the offense related to financial investment in money laundering and terrorist activities is proved, the following assets or instruments in the name, possession, ownership or any kind of interest of anyone related to the offense shall be confiscated:- (a) Laundered property, (b) Assets related to money laundering Means related to the offense used or intended to be used to commit the offence, (c) property obtained from the offense related to financial investment in terrorist activities, (d) used or earmarked for use for the purpose of financial investment in terrorist activities or terrorist acts or terrorist persons, terrorist organizations sought property, and (e) means used or intended to be used to commit an offense relating to financial investment in terrorist activities. (2) concealed, used, disposed of, possessed, possessed, or otherwise possessed the property or means referred to in sub-section (1); If it cannot be confiscated for any reason, other property of the offender equal to that value will be confiscated. (3) When confiscating property or means according to sub-section (1) or (2), the legal rights of innocent persons who are not involved in the crime shall be adequately protected. (4) Sub-section ( 3) Notwithstanding anything contained in sub-section (1) or (2) for the purpose of this, the court shall not confiscate the property or means of an innocent person who is not involved in the crime and the property increased therefrom if the following conditions exist:- (a) such person is involved in money laundering or terrorism. If it is not found to be involved in any crime related to financial investment in the activity, (b) if such property or instrument is not found to be the property obtained from the crime or the instrument related to the crime, (c) such property or instrument was obtained before the offense related to financial investment in money laundering and terrorist activities and such property Or if he does not know that the concerned person can use the instrument illegally.
